Citizens should be advised that no business is legally required to submit any information to the BBB. The deceptive practices of the BBB have recently been exposed by ABC News, to warn us about this so-called watchdog group. "Unfortunately, I have learned that we have within our country a private organization that with the appearance of being quasi-governmental and without any legal or regulatory oversight and control can libel and slander and tortuously interfere with a small business. Statement from Free Gas USA, Inc.
regarding the Better Business Bureau
Since 2008, the Better Business Bureau has published a misleading report on the corporate affairs of Free Gas USA, Inc. As a consequence, we offer the following facts to clarify and refute any deceptive claims made by this so-called consumer watchdog group.
BBB Claim:"Free Gas USA, Inc.'s telephone number is
FACT: Our telephone number is (269) 599-8717. We have never owned or sought permission to use the telephone number posted on the BBB's website.
BBB Claim:"The BBB investigated their charity status with the Michigan Attorney General's Charitable Trust Division and as of October 20, 2008, Free Gas USA Inc. is not registered to solicit in Michigan. The organization has countered the need to register claiming they are exempt as a church affiliated entity."
BBB Claim:"Despite written Better Business Bureau requests in the past year, this organization either has not provided current information or has declined to be evaluated in relation to BBB's charity standards. While participation in BBB's charity review efforts is voluntary, BBB believes that this lack of cooperation may demonstrate a lack of commitment to transparency. Without the requested information, BBB cannot verify if the charity adheres to BBB charity standards."
FACT: Free Gas USA, Inc. has refused to submit information to the BBB, because they are not empowered by any statute in the United States to regulate or investigate businesses. They concede that submission of records for charity review is strictly voluntary. However, refusal to submit records will result in a negative evaluation. Their claim of a lack of "transparency" is completely without merit. Any visitor to this website can freely access, download and print copies of our legal documents, which are located on the Library page. As a social services agency, we are prohibited, by law, from disclosing our clients' personal records. Finally, the "BBBcannot verify if the charity [Free Gas USA] adheres to BBB charity standards." Again, the BBB concedes that claims about our business practices should not have been evaluated. We wholeheartedly agree with this statement.
BBB Statement:"An organization may change its practices at any time without notice. Donors must decide for themselves the significance of any variation from BBB Standards, taking into account the relative importance of the practice in question in the context of the organization's total performance."
FACT: The Better Business Bureau's standards and practices are not sanctioned by the United States government, or any state government. Therefore, citizens should disregard reports published by this organization to avoid being sued for defamation or corporate sabotage. If you have a legitimate consumer complaint, contact your state attorney general or the Federal Trade Commission.
BBB Claim:"CALTRAN is the d/b/a of Free Gas USA, Inc."
FACT: Michigan Transportation Systems, dba CALTRAN, is a separate 501(c)(3) nonprofit enterprise. It serves as a fiduciary agency for Free Gas USA, Inc., to secure donations from private, corporate or philanthropic organizations that would otherwise be prohibited from contributing to a religious charity. When necessary, CALTRAN has granted permission for Free Gas USA to utilize its tax exempt status to satisfy corporate giving practices. Charitable gifts made via their online donation portal, Just Give, are forwarded to Free Gas USA, Inc.
